Campground Rules

GENERAL RULES

• Quiet time/lights out is from 11PM to 8AM­­.
• Pets are welcome and require a signed pet agreement.
• Catch And Release Fishing is allowed in the ponds.
• All pool rules & hours must be followed while in the pool area.
• We will be happy to receive your mail or package on occasion. Happy Acres Campground is not responsible for lost or stolen mail.
• All deliveries must be made to the camp store/office: Pizza to packages. 
• All golf carts must be registered in the office prior to use on the premises.
• Bicycle, scooter, and skateboard riding is allowed during daylight hours only.
• Motorbikes, mopeds, electric skateboards, electric scooters, and any other kinds of motorized vehicles are prohibited except for registered golf carts, power-assist bicycles, staff vehicles, and handicap scooters and wheelchairs.
• Smoking is prohibited inside any campground building, bathhouse, pool or other organized area.
• Do not walk through or park vehicles on other camper’s sites, use their water, electricity, or sewer hook-ups, or in any way disrupt their peaceful enjoyment of the campground.
• Offensive language, loud/excessive noise, interference with other campers, disturbing the peace, and willful or careless destruction of property in any manner are prohibited.
• Fireworks, firearms, other weapons, drugs, and any criminal activities are prohibited.
• Alcoholic beverages must remain on camper’s site.  Alcoholic beverages are not allowed at any other location in the campground without prior approval.
• Chain saws or any other power saws are prohibited.
• Defacing or damaging trees, tables, fire rings, or any other campground property is prohibited.

SITE AND RV RULES

• Two-vehicle limit on each site plus your RV or tent. All vehicles must be parked fully on site.
• EV charging is prohibited at sites.
• Trash should be deposited in the receptacles at the campground daily. Do not let trash collect at your campsite or in fire ring.  Boxes must be broken down first. No outside garbage is allowed.
• Use RV approved toilet paper only and do not flush paper towels, diapers, baby wipes, feminine products, condoms, needles, food, grease, flushable wipes, medicine, etc. at your site or in the campground bath houses.
• Do not move fire pits. Keep fires at a sensible level so as to not endanger trees or become a safety hazard. Do not leave fires unattended: extinguish it completely before leaving.
• Do not wash your RV or camper without prior approval. 
• No Unauthorized Dumping. Dumping gray or black water on the ground is strictly prohibited and will result in a substantial cleanup fee to the camper. There is a dump station available.
• Mechanical repairs to any vehicles or RVs are prohibited at the campground.
• You may not assign or sublet your site.
• If law enforcement is called for a disturbance at your site, you will be required to vacate the park.

TENT CAMPING

• Tent camping reservations must be made by phone
• 2-night Maximum (3-night Maximum on Holiday weekends)
• 2 Adults, 2 Tents, and 1 Car Maximum per tent site
• No utility or auxilary trailers permitted in the campground on tent sites
• Check in must be before the office closes.

CHILDREN

• Children under 12 must be supervised at all times. Children 14 years of age or younger must be supervised by an adult at all times while in the pool. Parents/Guardians are responsible for their children’s safe conduct, injuries, and or damage that they incur or cause. Children and minors causing disruptions for guests may be asked to leave the park with their group. 
• Playing in restrooms, store, park office and or climbing trees is not allowed.
• All minors must be back at their campsite by 10:30pm. Any minor out past this time must be accompanied by a parent or guardian.

GUEST POLICY

• Registered campers may have day guests on occasion between 9am and 11pm. All guests must register at the office/camp store prior to entry and pay a Guest Pass Fee.  Each day guest is entitled to attend scheduled activities (some may require an additional fee) and use the facilities.
• All guests must adhere to all campground rules and regulations. Registered campers are responsible for their guests and their guest’s behavior. Guests may not bring pets to the campground. Max 6 guests without approval.

DISCLAIMERS

Happy Acres LLC is a service-oriented business and therefore does not have a tenant/landlord relationship with any daily, weekly, monthly, or seasonal campers. All campers are guests of Happy Acres LLC.

Happy Acres LLC reserves the right to change the rules and rates without notice.

Management reserves the right to terminate reservation or refuse entry to any person who has evidenced a disregard for the rules. Any camper violating the rules may be asked to leave without refund.

WARNING - Under Indiana law, an agritourism provider is not liable for an injury to, or the death of, a participant in agritourism activities at this location if the death or injury results from the inherent risks of agritourism activity. Inherent risks of agritourism activities include risks of injury to land, equipment, and animals as well as potential for you to act in a negligent manner that may contribute to your injury or death, or for other participants to act in a manner that may cause you injury or cause your death. You are assuming the risk of participating in this agritourism activity.

Campers and guests of campers agree to use the campground at his/her own risk. Happy Acres LLC makes no warranty or representations as to conditions existing or that may hereafter exist upon the campground premises. Registered Adult Campers are responsible for all members of his/her party and guests. 

In consideration for use of the Campground, I agree and acknowledge as follows:

Conditional Permission: Permission to stay, camp, use amenities, participate in activities and events, and generally spending time at the Campground is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms and all rules and policies in effect at any given time. I understand that the Campground may revoke such permission at any time for any reason. I acknowledge that the Released Parties shall have no duty, obligation, or liability arising out of the provision of, or failure to revoke permission.

Assumption of Risk: To assume all risks of injury, damage, death, or any other harm to myself and any other person, pet, or property incidental to staying, camping, using amenities, participating in activities and events, and generally spending time at the Campground. It is all completely voluntary.

Release and Indemnity:  On my own behalf, everyone in my camping party, and on behalf of my heirs, executors, personal representatives, administrators, and assigns, knowingly and voluntarily 1) release and forever discharge Happy Acres LLC, their parent, related, and affiliated companies, and the officers, members, directors, employees, agents, representatives, or any professional selected by Happy Acres LLC to provide services for the Campground and guest’s (“ Released Parties”) of and from any and all claims, damages, liabilities, injuries, demands, actions, costs, or expenses, of any nature whatsoever, both present and future, whether known, unknown, anticipated, or unanticipated,  arising out of or in any way connected with my time at the Campground 2)  indemnify and hold each of the Released Parties harmless against any and all such claims, damages, liabilities, injuries, demands, actions, including costs, expenses, and attorney’s fees through and including any appeals. I expressly agree that this release and indemnity agreement includes, without limitation, any claims based on negligence, action or inaction of any of the Released Parties, and covers bodily injury (including death) and property damage.

Authorization for Medical Treatment: I hereby authorize medical treatment for myself and anyone in my party, at my expense and cost, if the need arises; however, I acknowledge that the Released Parties shall have no duty, obligation, or liability arising out of the provision of, or failure to provide medical treatment.

Governing Law, Venue: This provision shall be governed by the State of Indiana and enforceable to the fullest extent of the law. Any legal action relating to or arising out of this Agreement shall be commenced exclusively in Steuben County, Indiana.

I have read the above and agree to abide by all above conditions and rules relating to golf cart use at Happy Acres LLC.
