Pet Policies, Release, and Indemnity

We love our pets and we’re guessing that you do too.  It wouldn’t be the same camping without them. With that in mind, Happy Acres LLC (“Campground”) welcomes Pet Participation which means our guests have the opportunity to bring their furry friends with them during their stay. It also includes a fenced dog park and walking trails where guests can exercise pet(s).

For the safety and convenience of all guests, a few guidelines have been established while camping with pets. Owners not adhering to these policies will be required to either: 1) remove their pet(s) from the Campground for the remainder of the stay, or 2) have their entire party vacate the Campground without refund.

• The registered Campground Guest ("Owner") must be the owner of and take full responsibility for the pet(s).
• 2 pets per site. Dogs and cats are permitted. Fees apply for an additional pet. 
• Pets must be fully vaccinated, and campers agree to make records available upon request.
• All pets must be on a leash while in the campground and outside the RV or tent.
• At the campsite, all pets must be on a leash or tether while outside the RV or tent even at the campsite (including cats). The leash or tether must be short enough to keep the pet(s) a safe distance from neighboring sites and the streets.
• Pets cannot be left unattended outside the RV or tent at any time.
• The Campground discourages leaving pets unattended inside the RV. Although we do everything possible to make sure power is not interrupted, it is possible. No power = No A/C. Leave pets unattended inside your RV  at your own risk. 
• Pets are not allowed inside any campground building, office, camp store, bathhouses, pools, or any other campground structure.
• Owners are responsible for cleaning up after their pet while at your campsite and while walking around the campground. Failure to do so may result in clean-up fees.
• Excessive barking/meowing/whining is prohibited.
• Outside guests of Owners may not bring pets to the Campround without a signed pet agreement
• No aggressive dogs or cats allowed in the campground. Any dog or cat that has a history of biting, aggressive behavior, or have been removed from the Campground in the past is banned from the Campground.
• Emotional support animals must comply with all pet rules. 

In consideration for pet participation at the Campground, I agree and acknowledge as follows:

Conditional Permission: Permission to have pet(s) at the Campground is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these rules and other rules in effect at any given time. I understand that the Campground may revoke such permission at any time for any reason. I acknowledge that the Released Parties shall have no duty, obligation, or liability arising out of the provision of, or failure to revoke permission.

Assumption of Risk: To assume all risks of injury, damage, death, or any other harm to myself, pet(s), and any other person, pet, or property incidental to the pet’s participation and or presence at the Campground. Bringing pet(s) to the Campground is completely voluntary.

Release and Indemnity:  On my own behalf, everyone in my camping party, and on behalf of my heirs, executors, personal representatives, administrators, and assigns, knowingly and voluntarily 1) release and forever discharge Happy Acres LLC, their parent, related, and affiliated companies, and the officers, members, directors, employees, agents, representatives, or any professional selected by Happy Acres LLC to provide services for the Campground and guests (“ Released Parties”) of and from any and all claims, damages, liabilities, injuries, demands, actions, costs, or expenses, of any nature whatsoever, both present and future, whether known, unknown, anticipated, or unanticipated,  arising out of or in any way connected with the pet’s presence in the Campground, 2)  indemnify and hold each of the Released Parties harmless against any and all such claims, damages, liabilities, injuries, demands, actions, including costs, expenses, and attorney’s fees through and including any appeals. I expressly agree that this release and indemnity agreement includes, without limitation, any claims based on negligence, action or inaction of any of the Released Parties, and covers bodily injury (including death) and property damage.

Authorization for Medical Treatment: I hereby authorize medical treatment for myself, at my expense and cost, if the need arises; however, I acknowledge that the Released Parties shall have no duty, obligation, or liability arising out of the provision of, or failure to provide medical treatment.

Governing Law, Venue: This provision shall be governed by the State of Indiana and enforceable to the fullest extent of the law. Any legal action relating to or arising out of this Agreement shall be commenced exclusively in Steuben County, Indiana.

Owner specifically represents to Happy Acres LLC that to the best of Owner’s knowledge the pet(s) have not been exposed to rabies or distemper within a 30-day period prior to arrival. Owner also agrees that if the pet(s) is involved in an incident involving a bite and current rabies vaccination cannot be verified, it may be necessary to quarantine the Animal, subject to the discretion of the local health authority.

I have read the above and confirm my pet(s) meet(s) the guidelines listed above and agree to abide by all above conditions and rules relating to pet participation at Happy Acres LLC.
