Golf Cart Policies

• Golf carts must be in good condition, well-maintained, without damage, and safe to operate. Unsafe and or unsightly golf carts will not be allowed in the campground.
• Proof of liability insurance is required. Please attach a copy of the policy with this agreement
• A tag or sticker will be assigned and campers are required to display it at all times while the golf cart is on the property.
• Only licensed drivers can operate the golf cart at any time.
• Drivers must adhere to posted speed limits at all times.
• Golf carts cannot be driven after dark without operable vehicle mounted headlights. Holding flashlights or the like is not acceptable.
• Persons on a golf cart cannot exceed the number of legal seats.
• Pedestrians have the right away.
• Golf carts should only be charged during overnight hours. Daytime charging is prohibited.
• Management reserves the right to revoke the golf cart privileges of any person who has evidenced a disregard for the rules. In the event that privileges are revoked, camper agrees to remove the golf cart immediately or Happy Acres LLC will remove & store it at camper’s expense.
• Campers and guests of campers agree to use the campground and golf cart at his/her own risk. Happy Acres LLC makes no warranty or representations as to conditions existing or that may hereafter exist upon the campground premises that may affect the use of golf carts.
• Happy Acres LLC is not responsible for stolen or damaged golf carts or accidents, damages, injuries, and or deaths of any kind related to the use of a Golf Cart.

In consideration for the use of a golf cart at the Campground, I agree and acknowledge as follows:

Conditional Permission: Permission to have and use a Golf Cart at the Campground is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these rules and other rules in effect at any given time. I understand that the Campground may revoke such permission at any time for any reason. I acknowledge that the Released Parties shall have no duty, obligation, or liability arising out of the provision of, or failure to revoke permission.

Assumption of Risk: To assume all risks of injury, damage, death, or any other harm to myself and any other person, pet, or property incidental to the use of a golf cart at the Campground. Using a golf cart in the Campground is completely voluntary.

Release and Indemnity:  On my own behalf, everyone in my camping party, and on behalf of my heirs, executors, personal representatives, administrators, and assigns, knowingly and voluntarily 1) release and forever discharge Happy Acres LLC, their parent, related, and affiliated companies, and the officers, members, directors, employees, agents, representatives, or any professional selected by Happy Acres LLC to provide services for the Campground and guest’s (“ Released Parties”) of and from any and all claims, damages, liabilities, injuries, demands, actions, costs, or expenses, of any nature whatsoever, both present and future, whether known, unknown, anticipated, or unanticipated,  arising out of or in any way connected with the use of a golf cart in the Campground, 2)  indemnify and hold each of the Released Parties harmless against any and all such claims, damages, liabilities, injuries, demands, actions, including costs, expenses, and attorney’s fees through and including any appeals. I expressly agree that this release and indemnity agreement includes, without limitation, any claims based on negligence, action or inaction of any of the Released Parties, and covers bodily injury (including death) and property damage.

Authorization for Medical Treatment: I hereby authorize medical treatment for myself, at my expense and cost, if the need arises; however, I acknowledge that the Released Parties shall have no duty, obligation, or liability arising out of the provision of, or failure to provide medical treatment.

Governing Law, Venue: This provision shall be governed by the State of Indiana and enforceable to the fullest extent of the law. Any legal action relating to or arising out of this Agreement shall be commenced exclusively in Steuben County, Indiana.

I have read the above and agree to abide by all above conditions and rules relating to golf cart use at Happy Acres LLC.
